- Client Area means the account, order, invoice and service management interface accessed at cp.treas.net.tr;
- Service Period means the paid monthly or longer usage period, and Renewal Date means the date on which that period ends;
- Account Balance means the amount loaded into or refunded to the Customer's account that can be used to pay for Treas services.
2. Subject and Scope of the Agreement
This Agreement sets out the terms of use for the following services provided by Treas and the rights and obligations of the parties:
- virtual servers (VDS/VPS),
- dedicated (physical) servers,
- web hosting provided with the Plesk panel,
- colocation and IP leasing,
- TRSHIELD DDoS protection and additional services linked to these services.
The technical specifications, resources and price of each service are stated on the order page and in the Client Area; the scope of a service is limited to the selected package and additional services. Package-specific terms shown during ordering form an integral part of this Agreement.
By creating an account or placing an order, the Customer declares that they have read and accepted this Agreement and the Privacy Policy. Information on the processing of personal data is provided in the KVKK Information Notice. Where the Customer is a consumer, their rights under Law No. 6502 on Consumer Protection and related legislation are reserved.
3. Provision and Delivery of the Service
Treas provides the selected service in line with technical infrastructure and security standards, and takes the necessary care to provide the service continuously and securely.
- Virtual servers are set up automatically once payment is confirmed. Dedicated server, colocation and IP leasing services may require preparation time; the status of the order can be followed in the Client Area.
- Access details for the service are provided through the Client Area and/or sent to the registered email address.
- For server services, configuring, updating and securing the operating system and the software running on it are the Customer's responsibility. The scope of Treas's setup and support is limited to what is stated on the order page.
- In the colocation service, the hosted hardware belongs to the Customer.
- TRSHIELD DDoS protection aims to reduce the impact of attacks on the service; it is not guaranteed that every attack will be fully blocked. To protect the network and other customers, temporary measures (such as filtering, limiting or rerouting traffic) may be applied to IP addresses under attack.
Treas cannot be held liable for interruptions caused by force majeure, infrastructure failures beyond Treas's control or third parties (power, data center, carrier, etc.).
4. Customer Obligations
The Customer:
- must use the service in accordance with the applicable legislation, general morality and this Agreement,
- must keep their registration and billing information accurate, complete and up to date,
- must keep account and service access credentials (password, SSH key, API key, etc.) confidential and must not share them with third parties. The Customer is responsible for damage arising from unauthorized access; protecting the account with two-step verification is recommended,
- is personally responsible for the content and software hosted on the service and for the personal data processed within that content (as the data controller of that data),
- is responsible for backing up their data regularly; unless a separate paid backup service has been purchased, backing up data is not Treas's obligation,
- must not use server resources (processor, memory, disk, network traffic, etc.) excessively or abusively in a way that affects the service quality of other customers,
- must respond to Treas's abuse notices and notices from official authorities within a reasonable time.
5. Prohibited Uses
The following activities are prohibited on the services:
- hosting or distributing content that is illegal, harmful, threatening, insulting, obscene, racist, discriminatory or violent, or that constitutes terrorist propaganda, or that infringes the rights or intellectual property rights of third parties,
- spam, phishing, malware distribution, DDoS attacks, botnets, brute-force attempts, port scanning, attempts at unauthorized access and similar abuse,
- illegal file sharing, torrents, warez, cracks, adult content, gambling, illegal betting, illegal financial activities and similar uses.
If these prohibitions are violated, Treas has the right to apply the measures in the Suspension and Termination by Treas section and to notify the competent authorities.
6. Fees, Payment and Invoicing
- Service fees are determined by the selected package, service period and additional services, and are announced on the order page. Service fees are paid in advance for each service period.
- Payments can be made by credit/debit card (through the infrastructure of PayTR, a licensed payment institution), bank transfer/EFT or Account Balance. Card details are forwarded only to the payment institution at the time of payment and are not stored by Treas; card payments and saved-card transactions are carried out by the payment institution.
- Invoices are issued electronically (e-invoice/e-archive) and can be accessed in the Client Area. Invoices are issued according to the billing details registered in the Customer's panel.
- Account Balance is used to pay for Treas services; no interest accrues on the balance.
- Discount codes and campaigns are valid under the conditions and for the periods in which they are announced.
7. Renewal, Automatic Payment and Late Payment
- The service is extended by paying the fee for the next period by the Renewal Date. The Renewal Date is shown in the Client Area; Treas may send reminders, but keeping track of the date is the Customer's responsibility.
- The Customer can turn automatic renewal on or off in the Client Area. While automatic renewal is on, the renewal fee is charged to the Account Balance if it is sufficient, and otherwise to the saved card selected by the Customer.
- A service whose fee has not been paid by the Renewal Date may be suspended at the end of a grace period set by Treas. While suspended, the service cannot be accessed; once payment is made, the service is reactivated.
- If the fee for a suspended service is not paid, the service may be cancelled. The consequences for the data of a cancelled service are explained under Data of a Cancelled Service.
8. Package Upgrades
The Customer can upgrade their service to a higher package in the Client Area. On upgrade, the value of the remaining days of the current period is offset and only the difference is charged; the Renewal Date is kept. If one month or less remains until the end of the current period, a new one-month period starts from the upgrade date and the fee is calculated accordingly. The upgrade fee is shown on the payment screen.
Moving to a lower package is not possible through the Client Area.
9. Cancellation, Withdrawal and Refunds
Cancellation
The Customer can end their service by submitting a cancellation request in the Client Area. Two options are offered:
- Cancel at the end of the period: no renewal invoice is generated for the service, and any unpaid renewal invoice is cancelled. The service may be suspended at the end of the service period and then cancelled.
- Cancel immediately: once the request is approved, the service is terminated without a waiting period and open renewal invoices are cancelled.
Cancellation requests are carried out after they have been approved by Treas. The Customer is responsible for backing up their data before cancellation.
Data of a Cancelled Service
- Virtual servers and web hosting: the cancelled service and the data on it are permanently deleted and cannot be recovered.
- Dedicated servers: the server is taken out of service; the data on its disks is wiped according to Treas's procedure or the hardware is put back into use. The data cannot be recovered.
- Colocation: the hosted hardware belongs to the Customer and is not wiped by Treas; the hardware is returned to the Customer in coordination with Treas.
Refunds
- If a service is cancelled, no refund is given for the unused portion of a paid service period.
- In the case of duplicate or erroneous charges, or where the service could not be provided at all for reasons attributable to Treas, the amount concerned is reviewed by Treas and refunded to the card used for payment or to the Account Balance. Amounts paid with Account Balance are refunded to the Account Balance.
- The time it takes for a card refund to appear on your account depends on the processes of the bank that issued the card.
Right of withdrawal
Where the Customer is a consumer, under Article 15 of the Distance Contracts Regulation, the right of withdrawal cannot be exercised for contracts for services performed instantly in electronic form or for services whose performance has begun with the consumer's approval. During ordering, by ticking the confirmation box on the payment screen, the Customer explicitly accepts that performance of the service begins upon confirmation of payment and that there is therefore no right of withdrawal.
10. Support and Maintenance
- Treas provides 24/7 technical support. Support requests are submitted through the support system in the Client Area and answered in order of priority.
- Planned maintenance and updates are notified to the Customer in advance. In emergencies such as security vulnerabilities or hardware failures, the service may be temporarily stopped without prior notice.
11. Suspension and Termination by Treas
Treas may suspend or terminate the service in the event of use contrary to this Agreement, non-payment, detection of abuse, situations that threaten the security of the network or other customers, or decisions and requests of competent authorities. The Customer is informed to the extent that the nature of the situation permits.
12. Limitation of Liability
- Treas is not liable for data loss and damage arising from force majeure, infrastructure failures beyond its control, interruptions caused by third parties, or the Customer's own actions and errors.
- The Customer is responsible for data loss, security breaches and damage that may arise from their own configuration or software, or from failure to protect their access credentials, while using the service.
- This section does not remove liabilities that cannot be limited by law or the consumer's statutory rights.
13. Privacy and Personal Data
Customer data is protected under the Privacy Policy and Law No. 6698 on the Protection of Personal Data; details are provided in the KVKK Information Notice. Data is not shared with third parties other than as required by law and with the service providers needed to provide the service.
As a hosting provider, Treas keeps the records required by Law No. 5651 and related legislation and fulfills duly made requests from competent authorities.
14. Changes to the Agreement
Treas reserves the right to amend this Agreement. The current text takes effect from the date it is published on this page; material changes are announced through the website, the Client Area or email. The "Last updated" date at the top of the page shows when the text was last changed.
15. Governing Law and Disputes
This Agreement is governed by Turkish law. In consumer disputes, Consumer Arbitration Committees have jurisdiction within the announced monetary limits, and Consumer Courts have jurisdiction over disputes exceeding those limits.
